ANZAC Trading 2021

This year ANZAC Day, 25 April, falls on Sunday and like 2020 the public holiday is Mondayised. These regulations can often cause confusion, especially when combined with restricted trading conditions.

What is the effect of Mondayisation on shop trading restrictions?
 
The restrictions that apply to Anzac Day only apply on Sunday, 25 April 2021, so the Mondayisation of an employee’s public holiday does not affect restricted trading day rules.
 
Can you sell alcohol on a restricted day such as Anzac Day?
 
The Sale and Supply of Alcohol Act 2012 applies restrictions to trade on ANZAC Day (until 1 pm). These restrictions generally prevent bars and pubs from selling or supplying alcohol until 1 pm on ANZAC Day. However, for restaurants and cafes with liquor licences, your regular trading should be unaffected. So long as your customers are “on your premises for the purposes of dining”, you are free to provide them with a drink to accompany their meal until 1 pm on ANZAC day. After 1 pm no restrictions apply.
 
In particular: You are not permitted to sell alcohol on restricted trading days (until 1 pm on ANZAC day) unless this is with a meal. A hospitality business may open if they are selling: “prepared or cooked food ready to be eaten immediately in the form in which it is sold”. For example, a restaurant in which someone orders from the menu, (the meal is prepared and consumed on-site) does not have an issue opening on these days. However, a deli with food for sale that requires further preparation in any form by the customer before consumption would have some restrictions. Snack food is not “dining”. A person is not on your premises for dining if they are there 1 hour prior to eating their meal, or 1 hour after finishing their meal.
